NEWSPAPER REPORTS
The Times 29 July 1820 (Page 3)
EJECTMENT - Roe, Dem. RAINE v BUSTIN
"This was a question respecting the validity of a deed, by which William RAINE conveyed his estates at Mickleton in 1797 to George and Joseph his sons. He lived after the execution of the deed with his youngest daughter in Langley, for a period of about 20 years. In opposition to the terms of the deed, John BUSTIN, the deceased's son in law, kept possession of certain tenements. The action of ejectment was brought to try the validity of the deed and the defence rested upon the incompetency of William RAINE, the deceased, in 1797.
Thomas DENT, brother in law to Joseph RAINE and Anthony BUSTIN,, brother of the defendant but father in law of the plaintiff, George RAINE, who had attested the execution of the deed, swore to the competency of the deceased.
James LONGERWOOD, agent and gamekeeper to the Earl of Strathmore from 1793 to 1806 went for manor-rent to William RAINE and was told by him that he had made his lands away to his sons and that hey would pay. They did pay.
Mr BROUGHAM addressed the jury for the defendant. 'This was one of those actions which arose from disputes in the bosom of families and they were reduced to find their way through a mass of conflicting testimony: but he should produce witnesses who were wholly straight and even between the parties. The deceased had been a man of exceedingly weak understanding and both before and after 1797 incompetent to execute such a deed as that in question.'
John DENT, no relation to any of the parties, swore to the incompetency of the deceased. About 1797 he tried for a whole forenoon and could not count the steps of stairs.
Joseph TINKLER, a farmer, swore that he was what they called a weak man.
Tabitha RAINE, widow of the deceased's eldest son, swore that he had been a very easy man and did no business for himself.
Mr SCARLETT addressed the jury again. It was rather a hard measure which his learned friend would lay down - that the members of a family in such a question must be all guilty of perjury. But, as the case stood, the balance of testimony at least, was with the plaintiff. The history of the family was very natural: the youngest daughter lived with her father till she was married and then the father went to live with her. there was a common saying which was very true: "My son is my own till he had got him a wife; but the daughter is mine all the days of her life."
Verdict for the plaintiff.
